These Terms of Service govern your access to and use of Homaya, Inc.’s website and services (the “Service”). By using the Service, you agree to these Terms. If you’re using the Service on behalf of a business, you agree on its behalf.
1. The service
Homaya provides AI-assisted video monitoring that runs computer-vision checks on your existing store cameras and surfaces operational, safety, and loss-prevention events. The Service is a tool to assist your team. It does not replace human judgment, on-site security, or emergency services, and should not be relied on as your sole safety or security measure.
2. Accounts
You’re responsible for the credentials and activity under your account. Keep your login secure and tell us promptly if you believe it’s been compromised. You must provide accurate account information.
3. Acceptable use
You agree not to:
- use the Service unlawfully, or to infringe anyone’s rights;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its data;
- monitor cameras, people, or locations you don’t own or aren’t authorized to monitor.
You are responsible for complying with the laws that apply where you operate, including any notice or consent requirements for camera monitoring of employees and visitors.
4. Your data and footage
You retain ownership of your camera footage and store data. You grant Homaya a limited license to process it in order to provide, secure, and improve the Service. We handle your information as described in our Privacy Policy.
5. Pilots and trials
Pilot or trial access may be provided on an as-is basis and may be changed, limited, or ended at any time.
6. Intellectual property
The Service, its software, and the Homaya name and marks are owned by Homaya, Inc. These Terms grant you no rights in them other than the right to use the Service as permitted here.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. Detections are probabilistic and may include false positives and false negatives; Homaya does not guarantee that every incident will be detected or that alerts will always be delivered.
8. Limitation of liability
To the maximum extent permitted by law, Homaya will not be liable for any indirect, incidental, special, or consequential damages, and Homaya’s total liability arising out of or relating to the Service is limited to the amounts you paid for the Service in the twelve months before the event giving rise to the claim.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or its users.
10. Changes to these terms
We may update these Terms from time to time. If we make material changes, we’ll update the date above. Continued use of the Service after changes take effect means you accept the updated Terms.
